Terms Of Service

1) Who we are

Services may operate on infrastructure in Switzerland and other locations. We comply with Singapore PDPA and, where applicable, the EU GDPR.

2) Acceptance of these Terms

By creating an account, purchasing credits, ordering a file, accessing our API, or using our site, you agree to these Terms and our Privacy & Cookies notices. If you act for a business, you confirm you have authority to bind it.

3) Accounts & Eligibility

  • You must be 18+ and legally able to contract.
  • Keep credentials secure; you are responsible for account activity.
  • We may refuse, suspend, or close accounts for breach or risk.
  • Provide accurate vehicle/ECU references and details.

4) Orders, Pricing, Credits & Taxes

  • Prices are in USD unless stated; taxes (e.g., Singapore GST/VAT) may be added when required.
  • Payments via cards/wallets or credits. Credits are non‑transferable and, unless stated, non‑refundable and may expire after [e.g., 12 months].
  • We can change prices/availability going forward; accepted/paid orders are not affected.
  • You authorise us and our processors (e.g., Stripe/PayPal) to charge your selected method.

5) Delivery & Performance

  • Automated module: immediate results where supported; depends on correct input and ECU compatibility.
  • Manual file service: turnaround varies with workload; any estimates are not guarantees.
  • Delivery is digital (download/portal/email). Always back up your original file.

6) Refunds, Reworks & Chargebacks

Because deliverables are digital and custom, sales are final once a file is delivered or generated, except where: (a) we delivered a wrong/corrupted file and cannot fix it after reasonable attempts; (b) we charged you in error; or (c) otherwise agreed in writing.

Where statutory consumer laws apply (e.g., EU), you expressly request immediate performance and acknowledge you lose any withdrawal right once download/generation starts.

7) Your Responsibilities

  • Ensure vehicle condition is suitable; modifications are at your risk.
  • Provide accurate ECU identifiers (HW/SW refs) and use correct tools.
  • Verify delivered files before flashing; keep backups.
  • Use competent installers and follow tool/manufacturer guidance.
  • Comply with all applicable laws.

8) Compliance: Road Use, Emissions & Safety

Certain modifications (e.g., DPF/GPF/EGR/SCR/AdBlue removal) may be illegal for public‑road use in your country. Our products are for competition/off‑road use where permitted. You are solely responsible for legality, inspections, insurance, warranty, and roadworthiness.

9) Acceptable Use

  • No unlawful use or rights infringement.
  • No reverse‑engineering, reselling, or dataset building from our modules/databases.
  • No scraping, overloading, bypassing security, or submitting malware.
  • No misrepresentation of vehicle/ECU information.
  • No dangerous uses without appropriate safeguards.

10) Intellectual Property & License to Results

We retain all rights in our site, software, databases, and automated modules. Subject to payment and compliance, we grant a non‑exclusive, non‑transferable, non‑sublicensable licence to use the delivered modified file solely for the specified vehicle/ECU and solely for lawful purposes. You must not publish, sell, index, or train models on our outputs/data without written consent.

11) API & Partner Access

  • Keys are personal and must be kept secret.
  • Rate limits apply; we may throttle or suspend for abuse.
  • No caching/bulk‑download/dataset building unless agreed in writing.
  • Endpoints may change or be deprecated with reasonable notice.

12) Third‑Party Services

Payments, analytics, hosting, and other operations may involve third parties whose terms and privacy notices apply in addition to ours.

13) Service Changes & Maintenance

We may modify, suspend, or discontinue features with reasonable notice where practical. Planned maintenance may affect availability.

14) Warranties & Disclaimers

Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties (including merchantability, fitness for a particular purpose, and non‑infringement). Performance depends on factors outside our control.

15) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or lost‑profit damages. Our aggregate liability for any claim is limited to the amount you paid for the service giving rise to the claim in the preceding 12 months.

16) Indemnity

You agree to indemnify and hold us harmless from claims arising out of your unlawful use, breach of these Terms, or violation of rights/laws (including emissions/road‑use laws).

17) Suspension & Termination

We may suspend or terminate access for breach, risk, or legal compliance. You may close your account at any time. Sections that should survive (IP, licence, limits, indemnity, governing law, etc.) survive termination.

18) Governing Law & Dispute Resolution

Governing law: Singapore law. Disputes: final resolution by arbitration at SIAC under the SIAC Rules by one arbitrator. Seat: Singapore. Language: English. Urgent injunctive relief may be sought in court to protect IP/security.

19) Export Controls & Sanctions

You are not located in an embargoed country nor on any sanctions list, and you will not use our services in violation of export/sanctions laws.

20) Changes to these Terms

We may update these Terms; the “Last updated” date reflects the latest version. Material changes will be notified via the site or email where possible. Continued use after changes means acceptance.

  • “Automated module”: automated generation of modified files from structured inputs.
  • “API”: our programmatic interface, if enabled.
  • “You/Customer”: the account holder or business using our services.
